The problem is that you're trying to upload 3gp file.

This format can't be converted. It's used by 3G mobile phones... while newer one are recording to mp4.
Files can't be converted so they stay in pending and when tried to play, flash based player is loaded.
But you don't have flashplayer on mobiles thus you have that notification.
Outdated playback is used for outdated file format.
Ok so your saying everything is fine and working it's just my phone in general.
Is there something I can do to my phone to change it to record an Upload to mp4?

No, the problem is file format that can't be converted.
You may contact your hosting provider and ask about the details - why version of installed on the server FFMPEG do not convert 3gp files.
So files are just not converted and will sit in pending.
Also when trying to watch them flash based player - flowplayer will be used.
And you need to have flashplayer plugin installed.
Android phone can play flash videos out-of-the-box - you need to install flashplayer:

I don't know how to set your phone to record in mp4... you need to figure that out. 4G phones record in mp4 by default.
