here the fix:
edit /components/com_community/templates/jomsocial/layouts/photos.editalbum.php, after line 67, put this new code

<input type="hidden" name="groupid" value="<?php echo $album->groupid; ?>" />

replaced
creating an album now is created exclusively in the profile but not in the group, though it create a group.

$album->groupid = $jinput->get('groupid', '', 'NONE');
