i have a developer account, and am needing to do a tier upgrade from 2.6.3 -> 3+ on my website(s)

the "download old versions" link only gives me the "pro" accounts versions - i dont want to have issues post installation making sure that my final upgrade is a developer still - can you supply me with the 2.8 version of the developer etc or - does this not matter???

another site is recently upgraded now shows the latest version as "pro" in the ijoomler updater, so i am concerned about this process.

The most important is to make an last upgrade with dev package, so there's no need to upgrade to 2.8 with dev packages. Also iJoomler updater should automatically import your subscription, so it should shows developer license if you've one.
